Hazing

Legacy Policy

STATEMENT OF PURPOSE:

Utica University affirms the principle that its students, faculty, staff and guests have a right to work, study and enjoy the society of the University community without being subjected to an action or situation which recklessly or intentionally endangers mental or physical health or involves the forced consumption of alcohol or drugs for the purpose of initiation or affiliation with any organization.

SCOPE:

This policy applies to all members of the Utica University community including visitors to the campus and employees of vendors and contractors

POLICY:

Hazing is against New York State Law and is a violation of Utica University Code of Student Conduct. Hazing of any type will not be tolerated.

DEFINITION:

Hazing includes, but is not limited to, any action or situation, which recklessly or intentionally endangers mental or physical health or involves the forced consumption of alcohol or drugs for the purpose of initiation into or affiliation with any organization.

PROCEDURE:

Any employee, faculty or staff member found to have violated the anti-hazing policy shall be subject to disciplinary action set forth in the grievance procedure or in the contract between Utica University and the AAUP including but not limited to, immediate suspension or dismissal. All such penalties set forth above shall be in addition to any penalty pursuant to the New York State Penal Law or any other law to which a violator or organization may be subject.

RESPONSIBILITY:

All members of the University community are covered under this policy; however, resolution of charges may differ depending upon whether the individuals involved are students or employees of the University. Complaints against students will be processed through the dean of students’ office for resolution within the University student disciplinary system. Complaints against University employees will be forwarded to the Director of Human Resources for resolution within the appropriate University grievance procedure systems.

ENFORCEMENT:

Enforcement of Utica University policies is the responsibility of the office or offices listed in the “Resources/Questions” section of each policy. The responsible office will contact the appropriate authority regarding faculty or staff members, students, vendors, or visitors who violate policies.

Utica University acknowledges that University policies may not anticipate every possible issue that may arise. The University therefore reserves the right to make reasonable and relevant decisions regarding the enforcement of this policy. All such decisions must be approved by an officer of the University (i.e. president, vice president for academic affairs, or vice president for financial affairs).
